Online Lawyer

The Online Lawyer Service is available to individuals over the age of 16 and to legal entities, accessible through placing an order in the “Online Lawyer” section of the website.

By using the service, you consent to provide accurate, up-to-date, and comprehensive information about yourself.

The order for the purchase of  `Online Lawyer`  Service will be made by completing the form available to the user on the website.

The electronic form represents the contract concluded between the parties.

The parties to the contract will be called the Client and the Lawyer.

Online Lawyer services can be paid for by cardbank transfer or cash at the Transilvania Bank headquarters or at our HQ- by paying the fee depending on the service chosen ( Property& Real Estate, Contracts& Corporate Law, IT Law, Intellectual Property& Patents, Employment Law, Family Law, Visa& Immigration, Criminal Law, Document Study, Other Legal Cases ).

The duration of an online consultation varies between 30 to 60 minutes.

Online consultations can be conducted via audio or video, tailored to the client’s capabilities and requirements.

The consulting service generally does not cover the preliminary review of legal documents, with exceptions in specific circumstances and based on the selected consulting service.

The legal services provided by the lawyer represent obligations of diligence (or means) and not obligations of results.

Through the lens of this obligation of diligence, it is understood that the lawyer undertakes to make all the necessary efforts to achieve the possible result, without actually committing to the respective result.

The legislative framework of this obligation of diligence is established by Law no. 51/1995 for the organization and exercise of the lawyer profession.

To initiate an online consultation, the following steps must be followed:

Step 1

A first introductory discussion with a lawyer, by e-mail, live-chat or telephone.

Once you’ve chosen a consulting service, begin by completing the electronic form with your details, including your phone number.

Specify a time slot and the days you are available for the online consultation, as well as your preferred format (audio, video, etc.).

Provide a brief overview of your legal issue, review the terms and conditions, the privacy policy, and express your consent to proceed with placing the order.

Step 2

Payment for the consulting service – can be made with the Card (Visa and MasterCard are accepted) in a perfectly secure environment, through an authorized processor (Stripe, bank transfer or cash at the Transilvania Bank headquarters or at our HQ (in this case a proforma invoice will be issued for related services).

Step 3

Following the confirmation of the Online Legal Consultation, a lawyer will contact the client on the agreed-upon date and time.

The online consulting activity provided by a lawyer from the theromanianlawyers.com team is for a fee, and the payment of the fee will be paid at the time of completing the electronic form.

The payment will be paid in full before setting the appointment, the payment will be ratified by the email confirming the consultation.

Payment for online consulting services can be made by card, bank transfer or cash at the Transilvania Bank headquarters, by paying the fee depending on the Service chosen.

The lawyer will issue an invoice for the online consultancy service and send it via email within 48 hours following the completion of the consultancy session.

In cases where the online consultation was not conducted by a member of the Theromanianlawyers.com team, the fee may be refunded only under certain conditions and within a maximum period of seven days from the client’s request for such a refund.

However, there is a scenario where the client may use the fee, with the consent of a representative from Theromanianlawyers.com, to schedule a new online consultation. This appointment must be requested within a maximum of 48 hours from the initially scheduled consultation date.

When the Cancellation of the Order has occurred, this represents an incident and it will be solved as it follows:

  • The online legal consultation was not provided by the lawyer, due to his fault, in which case the Client is notified before the time established for the initiation of the online consultation, he also having the possibility to agree with the lawyer to postpone the online consultation for a later date, within 30 days;
  • The customer withdraws the Order within a maximum of 1 hour after making the appointment, in the case of the appointment of the Online Consultant for the same day;
  • The Customer withdraws the Order at least 24 hours before the time set for Online Consulting, in the situation where the Order was placed at least 24 hours before;
  • The Customer withdraws his Order at least 48 hours before the time established for Online Consulting, in the situation where the Order was placed at least 48 hours before;
  • The client sends incomplete and/or erroneous information through the appointment form, which represents insufficient elements to outline a legal case/problem of a legal nature, to questions formulated incorrectly or unintelligibly;
  • The client notifies the lawyer of a complex problem and a large number of documents that require an in-depth study, which cannot be answered within the deadline requested by the client.
  • The lawyer reserves the right to refuse to provide services for illegal and immoral purposes. If the Lawyer considers that the request for legal services may have an immoral or illegal purpose, he will inform the Client about the refusal to provide the requested services;

The appointment for the online consultation can be canceled by a representative of the Theromanianlawyers.com team, with prior notice to the Client, the return of the fee, possibly the return of the documents, in the following exceptional situations:

  • The transaction was not validated by Stripe Platform;
  • The transaction was not accepted by the issuing bank of the Client’s card;
  • The customer has not fully completed the Order, as it has not been fully and correctly accessed;
  • com appreciates that by accessing the online platform and placing the Order, the Customer pursues an illicit, immoral goal or may cause any kind of damage to the theromanianlawyers.com team;
  • The present terms and conditions are not respected;

Online consulting cannot be honored for reasons beyond Theromanianlawyers.com `s control, such as force majeure events, epidemics/pandemics, fires, explosions, wars, acts of terrorism, etc.

In the event that the Client wishes to withdraw the fee paid, he can do so and the fee can only be returned under the conditions mentioned above.

In the conditions in which the stages regarding the right to withdraw the Order, the appointment for online consultation are not respected, the Client loses the right to the fee and its restitution, by the Client becoming aware of the terms and conditions of the contract concluded at a distance by which he given the agreement regarding the step taken.

The online consultation by an Theromanianlawyers.com team lawyer represents:

  • Answers to questions addressed to the Theromanianlawyer.com team regarding the Client’s legal problem;
  • Propose optimal legal solutions, in connection with the problem communicated by the client, if the client requests it;
  • Offers recommendations regarding the legal situation for which legal consultation is requested;

Should the client fail to provide accurate or complete information, or if the requests are ambiguous, the team at Theromanianlawyers.com is entitled to exert all necessary efforts to attain the desired outcome.

However, Theromanianlawyers.com reserves the right to decline compliance with such requests.

Should the connection be interrupted during an online consultation, irrespective of the cause or the parties’ intent, and if it is not re-established within 15 minutes from the disruption, the remaining consultation time may be rescheduled once, within a 30-day period, under the same terms.

Should there be any delays in the online consultation provided by the Theromanianlawyers.com team that do not surpass 15 minutes, the consultation will be extended by an additional 15 minutes. However, if the delay exceeds 15 minutes, the client is presented with two options: the opportunity to reschedule the consultation or to receive a refund of the paid fee.

In the event that there are delays regarding the online consultation on the part of the Client, and this delay does not exceed 15 minutes, the consultation is extended by 15 minutes, but if this delay is greater than 15 minutes, the Client has the possibility to reschedule the online consultation within a maximum of 30 of days from the date on which the initial appointment was established, at his request, when the Theromanianlawyers.com team is available.

 The fee will not be refunded if the Client does not want a rescheduling within a maximum of 30 days.

If the Client, during the online consultation, brings up new legal issues, apart from those reported through the Order and which lead to a thorough investigation, the Theromanianlawyers.com team reserves the right not to provide legal advice regarding these new issues.

If an online consultation lasts less than the duration for which the Client has paid and it ends with the Client’s agreement, no amount is returned to the Client as representing the value of the unpaid consultation time.

The fee is not divisible.

If an online consultation exceeds the duration paid by the client, the Client has the possibility to reschedule in the conditions where the Theromanianlawyers.com team cannot continue the online consultation.

The client will be informed of the additional fee, and the online consultation can only be continued after payment of the fee.

The online consultation must comply with certain rules of conduct, in a civilized setting, without licentious or inappropriate language, without offenses and without insults on the part of the Client, as well as on the part of the Theromanianlawyers.com team.

To the extent that these rules are violated, the Theromanianlawyers.com team reserves the right to put an end to the online consultation started or even not started, and the fee charged will not be refunded.

The answers, solutions and proposals offered by the Theromanianlawyers.com team must be understandable to the Client, so that he can understand the Client’s problem from a legal point of view.

The provisions of Law no. 51/1995 on practicing the profession of lawyer, republished, with the subsequent changes of the Statute of the profession of lawyer, regulate the preservation of professional secrecy, by preserving the confidentiality of all documents communicated to the Theromanianlawyers.com team on the online platform.

By accepting the terms and conditions mentioned above, the client accepts the offer to provide the legal services of Online Consulting as they are displayed on the website, and agrees to the conclusion of the remote legal assistance contract, with the object of providing the legal consulting services of Online Consulting, as requested by the client.

This legal assistance contract is in accordance with the provisions of the law and the Statute of the lawyer profession, enforceable, regarding the amounts owed by the client, as fees and related expenses.

The relations between the parties can only be proven with this legal assistance contract and/or under the conditions provided by the Statute of the lawyer profession.

With respect to third parties, the proof of this legal assistance contract is made by means of a power of attorney.

This legal assistance contract cannot be made known to third parties, except with the express agreement of the Parties.

The Client attests to the accuracy and sincerity of the information he provides to the Provider and expresses his agreement that the steps taken by the Provider are in accordance with the information he provided.

This legal assistance contract is subject to the provisions of Law no. 51/1995 on practicing the profession of lawyer, republished, with the subsequent changes of the Statute of the profession of lawyer.

The termination of this legal assistance contract, regardless of the reason, has no effect on the rights acquired by any of the Parties, until the date of termination.

All disputes regarding the creation, modification, termination and interpretation of this legal assistance contract are subject to the arbitration rules provided by law and the Statute of the lawyer profession.

We reserve the right to make changes to the content of the terms and conditions, without notifying site users.

Conciliation.

Although we act so that you, Our Client, are satisfied, if you have any dissatisfaction with the services offered by the Theromanianlawyers.com team, please contact us through the contact form or by phone at +40 765 366 887 .

Any conflict arising between clients and the company is tried to be resolved amicably, by agreement between the two parties.

If the conflict has not been resolved amicably, the competence rests with the Courts of Romania, Bucharest.
